In a recent press conference held on Friday, September 27, Me Djiby Diallo, the lawyer representing Jérôme Bandiaky, addressed the troubling circumstances surrounding his client’s arrest. Bandiaky, a former member of the Alliance for the Republic (APR) security team, was apprehended under questionable conditions that raised concerns about due process.
Controversy Over Arrest Conditions
Me Diallo condemned the aggressive tactics employed by the police during their raid at Bandiaky’s home, pointing out that there was neither prior summons nor complaint against him. According to the lawyer, such an approach is not only unorthodox but also fundamentally flawed, as individuals should be summoned and questioned before facing arrest.
Legal Implications and Defense Arguments
Regarding the allegations of illegal possession of firearms, Me Diallo clarified that the weapons discovered belong to Bandiaky’s security company and were intended for his protection. Known as the ‘sniper,’ Bandiaky provided security services for former Prime Minister Amadou Ba and former President Macky Sall. Additionally, the lawyer emphasized that claims linking Bandiaky to serious crimes, such as the disappearances of Didier Badji and Fulbert Sambou, have no basis, asserting that he is neither implicated nor pursued for these offenses.
Me Diallo further elaborated on his argument that many of the accusations against Bandiaky fall under an amnesty law that cannot be repealed. He raised the question; why revisit an amnesty law that has already had tangible effects, benefitting members of the current regime as well?
Finally, the lawyer expressed his disappointment over the lack of support from former dignitaries who have neglected to recognize Bandiaky’s contributions to their security.
